Terms of service

These terms explain the rules for using Fossil Fuel, including important food-safety, subscription and service-change provisions.

1. Agreement and who we are

These terms form an agreement between you and Extinct & Co., the operator of Fossil Fuel. We are based in Glasgow, Scotland, United Kingdom. Contact us at info@extinctandco.com.

By creating an account or using Fossil Fuel, you agree to these terms and acknowledge our privacy notice. You must be at least 18 and legally able to enter into this agreement. If you do not agree, do not use the service.

If you use Fossil Fuel on behalf of a household, you are responsible for ensuring that you are authorised to provide its information and to make relevant planning decisions.

2. What Fossil Fuel provides

Fossil Fuel is a meal-planning and household-organisation service. Depending on your plan and platform, it may provide meal suggestions, recipes, nutrition and cost estimates, shopping lists, batch-cooking plans, calendar feeds, household sharing, referrals, retailer basket transfers, notifications, widgets and wearable features.

Recommendations are generated from available recipes, product information and the preferences you provide. They are planning aids, not guarantees. You remain responsible for deciding what to buy, prepare, serve and consume.

3. Allergies, intolerances and food safety

Important: never rely on Fossil Fuel as your only allergy or dietary check.

Allergen, dietary, ingredient and substitution information may be incomplete, inaccurate, delayed or affected by cross-contamination, retailer substitutions and changes made by manufacturers or recipe publishers. A product or recipe shown as suitable may not be safe for you or another person.

You are responsible for checking the complete ingredient list, allergen declarations, precautionary “may contain” statements, preparation environment and physical packaging of every product each time it is purchased and before it is consumed. Manufacturers can change recipes without notice. If packaging conflicts with Fossil Fuel, the packaging and information supplied by the manufacturer or retailer must be treated as authoritative.

You must also check substitutions and retailer-selected replacements independently. Do not use or consume a product if information is missing, ambiguous, inconsistent or unsuitable. Contact the manufacturer or retailer where necessary.

If you or someone you feed has an allergy, intolerance, coeliac disease, a medically restricted diet or another condition that could cause serious harm, seek advice from an appropriately qualified healthcare professional. Fossil Fuel does not replace an allergy action plan or emergency medical advice.

4. Nutrition, calories and health goals

Calories, macronutrients, portions, costs and other measurements are estimates. Values can differ because of brand, pack size, preparation, cooking loss, serving size, missing data, substitutions and source errors. “Average”, “per meal” and “per portion” values are not laboratory measurements.

Fossil Fuel does not provide medical, nutritional or dietetic advice and is not intended to diagnose, treat, cure or prevent any condition. Do not use it for urgent or clinical decisions. Speak to a GP, registered dietitian or other qualified professional before making material dietary changes, particularly during pregnancy, for children or if you have a medical condition.

5. Grocery products, availability and price estimates

Displayed grocery prices, availability, pack sizes, promotions and estimated meal or shopping costs may be delayed, incomplete or different at checkout. Retailers control their products, substitutions, geographic availability, delivery slots, minimum orders, fees and final prices. The retailer’s checkout is authoritative.

A shopping list or basket transfer does not reserve stock, place an order or create a purchase unless the relevant retailer clearly confirms it. You are responsible for reviewing quantities, products, allergens, delivery details and the final total before placing an order.

6. Accounts, security and households

You must provide accurate information, keep your credentials and devices secure, and promptly tell us about suspected unauthorised access. You are responsible for activity performed through your account unless caused by our failure to use reasonable care.

Household members may view and change shared information. Only invite people you trust. The account identified as household owner may control membership and shared access. If a paid household entitlement ends, we may separate linked accounts or restrict shared features while preserving each person’s individual account where practicable.

Calendar feeds, household invitations, referrals and public recipe links may be accessible to anyone holding the relevant link. Keep private links confidential and rotate or revoke them when available if they are exposed.

7. Plans, trials, payment and cancellation

Fossil Fuel may offer Free, Plus and Ultra plans, monthly or annual billing, and time-limited trials. The price, billing interval, included features, trial end date and whether a subscription renews automatically will be shown before purchase. Taxes may apply.

Payments are processed by Stripe or the relevant app store. Your subscription will renew at the stated interval until cancelled, unless the checkout says otherwise. You authorise the payment provider to collect the applicable recurring amount.

You can cancel through the billing portal, the app store through which you subscribed, or another cancellation method we make available. Cancellation normally stops renewal and paid access continues until the end of the paid period. Deleting the app does not cancel a subscription.

Any statutory cooling-off, refund or cancellation rights that apply to you remain unaffected. If you ask for immediate access to digital content or services during a cooling-off period, the effect on those rights will be explained where the law requires it. Refunds beyond your statutory rights are not guaranteed unless stated at purchase or required by the payment provider’s rules.

Trials may be limited to one per person or household. We may prevent repeated, overlapping or abusive trial use.

8. Changes to prices, plans and features

We may develop, add, remove, replace, suspend or deprecate features, integrations, platforms, usage limits and plan entitlements. We may also change subscription prices to reflect product development, provider costs, inflation, taxes, regulation or changes to the service.

Minor changes, beta experiments and changes that do not materially reduce your paid service may take effect when released. For a material reduction to a paid plan, or a price increase applying to your next renewal, we will give reasonable advance notice where practicable and as required by law. The notice will explain when the change takes effect and how to cancel.

Price changes will not alter amounts already paid for the current billing period. If you do not accept a notified change, you may cancel before it takes effect. Nothing in this section allows us to change your contract arbitrarily, remove statutory rights or charge a new amount without the notice or consent required by law.

Some features may move between Free, Plus and Ultra, become subject to limits, or be withdrawn if a provider ends an integration or continued operation becomes unsafe, unlawful or commercially impracticable. Where a change materially affects a prepaid service, we will provide any remedy required by consumer law.

9. Third-party services and content

Fossil Fuel may link to or exchange information with payment providers, calendar services, recipe publishers, retailers, delivery services and other third parties. Their own terms, privacy notices and availability apply. We do not control their products, services, content, prices, substitutions or refresh schedules and are not their agent unless expressly stated.

Calendar providers decide when subscribed feeds refresh. Exporting or subscribing does not guarantee immediate or continuous synchronisation. Removing information from Fossil Fuel may not remove copies already held by an external calendar or other service.

10. Content and intellectual property

Fossil Fuel, its software, design, branding, databases and original content are owned by us or licensed to us and are protected by intellectual-property law. Recipe titles, source material, product information and third-party marks may belong to their respective owners.

We give you a personal, limited, non-exclusive, non-transferable and revocable right to use Fossil Fuel for lawful household purposes while these terms apply. You may not copy, sell, scrape, reverse engineer, redistribute or commercially exploit the service except where the law expressly permits it.

You retain ownership of original recipes, notes and other content you submit. You grant us a worldwide, non-exclusive licence to host, reproduce, adapt and display that content only as needed to operate, secure and improve the service and provide sharing features you request. You confirm that you have the right to submit it and that it does not infringe another person’s rights.

11. Acceptable use

You must not misuse Fossil Fuel, attempt unauthorised access, interfere with security or availability, probe or overload our systems, introduce malware, automate access contrary to our instructions, harvest personal data, impersonate others, infringe rights, or use the service for illegal, harmful or fraudulent activity. You must not publish secret household or calendar links belonging to someone else.

We may investigate suspected misuse, apply reasonable technical limits and suspend access where necessary to protect users, the service or third parties.

12. Beta status and availability

Fossil Fuel may include beta or early-access functionality. Such functionality may contain errors, change frequently or be withdrawn. We aim to provide a reliable service but do not promise uninterrupted, error-free or permanently available access. Maintenance, incidents, connectivity, device compatibility, third-party failures and legal or safety requirements may affect availability.

We may discontinue Fossil Fuel or a substantial part of it. Where reasonably possible, we will give advance notice and an opportunity to export relevant data. If discontinuation affects a prepaid service, we will provide any refund or other remedy required by law.

13. Our responsibility to you

We do not exclude or limit liability where it would be unlawful, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or breach of rights that cannot legally be excluded.

If we fail to comply with these terms, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, business losses arising from consumer use, or failures caused by events outside our reasonable control.

Subject to the rights above, you are responsible for verifying food, allergy, nutrition, retailer and calendar information before relying on it. We are not responsible for a manufacturer changing ingredients, a retailer making a substitution, inaccurate third-party data, or a user ignoring a warning or failing to check the product actually purchased.

Nothing in these terms affects your statutory consumer rights, including rights relating to digital content and services supplied with reasonable care and skill.

14. Suspension, termination and data

You may stop using Fossil Fuel at any time. You can clear your app data while retaining your login and membership, or permanently delete your account. Permanent deletion also instructs Stripe to stop an eligible recurring subscription renewing at the end of its current paid period. Subscriptions purchased through another provider must be cancelled through that provider unless we expressly confirm otherwise.

We may suspend or terminate access if you materially or repeatedly breach these terms, create a security or safety risk, fail to pay an amount due, or if we must do so by law. Where appropriate, we will explain the reason and give you a reasonable opportunity to remedy the issue or appeal, unless doing so would compromise security or legal obligations.

Terms which by their nature should continue—such as ownership, accrued payment obligations and lawful limits of liability—survive termination. Our handling of information after termination is described in the privacy notice.

15. Changes to these terms, governing law and contact

We may update these terms to reflect service, legal, security or business changes. We will post the current version and date here. We will give reasonable advance notice of material changes where practicable. If a change materially disadvantages an existing paid subscription, you may cancel before it takes effect and retain any remedy the law provides.

These terms are governed by Scots law. If you are a UK consumer, you may bring proceedings in the courts of the part of the UK where you live. If you live elsewhere, mandatory local consumer protections and jurisdiction rights may also apply.

If part of these terms is found unenforceable, the remaining terms continue. A delay in enforcing a right does not waive it. No person other than you and us has a right to enforce these terms.
